1. By Design Bakes Agreement
By placing an order with By Design Bakes, you acknowledge and agree to the following terms:
- Ingredients: Our cookie recipe contains flour, butter, water, sugar, eggs, baking powder, salt, powdered sugar, meringue powder, vanilla extract, and food coloring.
- Cottage Law Notice: These products are prepared in a home kitchen, not a commercial facility.
- Allergen Notice: While our recipe does not include peanuts or tree nuts, our home environment is not nut-free. The customer acknowledges this allergen risk and agrees to hold By Design Bakes harmless for any allergic reactions experienced by the client or event guests.
- Payments & Refunds: All sales require full upfront payment and are strictly final. Refunds are not issued unless explicitly determined otherwise by By Design Bakes management.
2. By Design Events: Face Painting Agreement
By purchasing face painting services from By Design Events, LLC, you agree to hold the company harmless from any conditions, adverse reactions, or issues that may arise after services are performed. This liability waiver applies to both the hosting client and all event attendees. All sales require upfront payment, are considered final, and are non-refundable except at the sole discretion of By Design Events, LLC.
3. By Design Events: Balloon Services Agreement
By purchasing balloon services from By Design Events, LLC, you agree to hold the company harmless from any conditions, damages, or harm that may arise during or after the services are performed. This liability waiver applies to both the hosting client and all event attendees. All sales require upfront payment, are considered final, and are non-refundable except at the sole discretion of By Design Events, LLC.
4. Inclement Weather & Outdoor Setup Policy
By Design Events, LLC is not responsible for balloon damage caused by weather conditions (such as rain, high winds, or extreme heat). If your event is outdoors, you agree to the following terms:
- Backup Indoor Plan: The client is highly encouraged to provide an indoor backup location. If weather conditions threaten the balloon installation, the setup will automatically be moved to the indoor alternative.
- Cancellations: If an outdoor event must be canceled entirely due to weather, payments remain non-refundable. However, at the sole discretion of By Design Events, LLC, a credit may be applied toward a rescheduled date within 6 months, subject to calendar availability.
- No Adjustments for Degradation: Once outdoor installations are completed and accepted, By Design Events, LLC is not responsible for popping, deflation, or changes in appearance caused by sun, wind, or rain.
